hereinafter referred to as Provider, the contract is concluded.

Contractual Object

This contract regulates the sale of new goods or so called Growth Hacks from the marketing and web development sector(s) via the supplier’s online shop. For details of the respective offer, please refer to the product description on the offer page.

Conclusion of Contract

The contract is concluded exclusively in electronic business transactions via the shop system. The offers presented represent a non-binding invitation to submit an offer by the customer order, which the provider can then accept.

The ordering process for the conclusion of a contract includes the following steps in the shop system:
Selection of the offer in the desired specification (type, number)

• Adding the offer to the shopping cart
• Press the button ‚Continue to checkout‘
• Entering the invoice and delivery address
• Selection of payment method
• Press the button ‚Order now at the price shown‘
• Confirmation mail that order has been received
• With the sending of the order confirmation the contract is thereby seen as part of the order.
• Clients receives instructions of who the Growth Hack will be delivered.

Term of a Contract

The contract is concluded for an indefinite period.

Reservations

The provider reserves the right not to provide the promised service if it is not available. The website would notify it or the provider will inform the client in less than 48 hrs after receiving an email confirmation of the purchase.

Prices, Shipping Costs, Return Shipping Costs

All prices are final prices and include the legal value added tax. Per order no shipping costs are incurred as the Growth Hacks are digital services. In the case of the delivery of Downloadable assets that would require a deposit of large memory, the price and costs would be covered by the client.

These are indicated in the context of the order process and before the binding order. In the case of partial deliveries, the flat rate is incurred only once. If there is a right of revocation and use is made of this, the customer bears the cost of return.

Terms of Payment

The customer only has the following options for payment: payment service provider (PayPal), (STRIPE) , SEPA , DIRECT TRANSFER prepayment. Other payment methods are not offered and will be rejected. If a trustee service/payment service provider is used, the trustee/payment service provider enables the provider and the customer to process the payment with each other. The trustee/payment service provider forwards the customer’s payment to the provider.

Further information can be found on the website of the respective trustee/payment service provider. In the case of payment by credit card, the customer must be the cardholder. The credit card is debited after the order have been confirmed. In some cases like with SEPA The customer is obliged to pay within 1 to 3 days of receipt of the credit card or debit card.

Payment is due without deduction from the date of invoice. The customer shall only be in default after a reminder. The customer’s right of retention, which is not based on the same contractual relationship, shall be excluded. Offsetting against the customer’s claims shall be excluded, unless these are undisputed or have been legally established.

When paying by PayPal, you pay directly through your PayPal account. After submitting your order, you will be redirected to PayPal and make the payment. Your PayPal account will be debited immediately with the actual invoice amount after deducting any discounts, gift certificates, etc. The contractual relationship between PayPal and its customers is governed solely by the PayPal Terms of Use.

Terms of Delivery

The goods will be shipped as agreed upon with the terms of each Growth Hack after confirmed receipt of payment. The shipping takes place on average after 3 days at the latest for basic Growth Hacks, and after 7 days on Premium Hacks. The entrepreneur commits himself to delivery on the 5th day after confirmed receipt of payment. The normal delivery time is 3 days, unless otherwise stated in the item description.

The supplier ships the order from his own main office as soon as the entire order is available there. If the supplier is not responsible for a permanent delivery obstacle, in particular force majeure or non-delivery by his own suppliers, although a corresponding covering transaction was made in time, the supplier has the right, in this respect from a contract.

Warranty

Consumers are entitled to statutory liability for defects for the services offered. The warranty shall be governed by the provisions of the General Terms and Conditions of Business, which have been drawn up for this purpose, and this shall not apply to claims for damages by the customer due to injury to life, limb, health or essential contractual obligations which must necessarily be fulfilled in order to achieve the contractual objective.

This shall also not apply to claims for damages due to grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent.

Right of Withdrawal for Entrepreneurs

The regulations for distance contracts are not applicable to customers who are entrepreneurs. Therefore, these customers are not entitled to a corresponding right of revocation due to distance contracts. The provider does not grant such a right either.

Disclaimer

This shall also apply to the Provider’s representative and vicarious agents if the Customer asserts claims for damages against these claims, with the exception of claims for damages by the Customer due to injury to life, limb, health or essential contractual obligations which must necessarily be fulfilled in order to achieve the contractual objective, and claims for damages due to gross negligence or wilful breach of duty by the Provider or its legal representative or vicarious agents.

Prohibition of Assignment and Pledging

Claims or rights of the Customer against the Provider may not be assigned or pledged without the Provider’s consent, unless the Customer has proven a justified interest in the assignment or pledge.

Language, Place of Jurisdiction and Applicable Law

The contract shall be drawn up in English. The further execution of the contractual relationship shall be carried out in English. The law of the Netherlands shall apply exclusively. For consumers, this shall only apply insofar as no legal provisions of the state in which the customer has his residence or habitual abode are restricted thereby. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law shall be the registered office of the provider.

Data Protection

In connection with the initiation, conclusion, settlement and reversal of a sales contract on the basis of these General Terms and Conditions, data is collected, stored and processed by the provider within the framework of the statutory provisions. the provider does not pass on any personal data of the customer to third parties unless he is legally obliged to do so or the customer has expressly consented in advance.

If a third party is used for services in connection with the settlement of processing processes, the provisions of the Federal Data Protection Act are complied with. the data provided by the customer by way of an order is used exclusively to establish contact within the framework of contract settlement and is processed only for the purpose of the order.
